Can anyone help me? Ga had some bad storms the last few weeks. 2 weeks ago the top neighbors tree landed in my yard and took down our power lines. We paid to have the tree removed. Today a huge tree fell across my backyard & destroyed part of our fence. Is my neighbor responsible?
Did you try calling your homeowners insurance company? They could probably tell you if you could claim through them or if you should contact your neighbors. My mom had the opposite instance from mary97 and when a neighbors tree broke part of her fence, they paid to fix it. Not sure if it was through insurance or not though.
It really depends on your town/county. At least it does here. My neighbor wanted to remove a tree in their own yard, but still had to get consent from us, which I thought was weird. Another neighbor is held accountable if any large pieces fall into the yard next to them. So ya never know. Calling your insurance is a good idea as well.
I don't know if this is only how it is in Canada, but have always heard that it is the person's responsibility where the tree originates. The tree was on their property not yours.
Thanks everyone. I guess we will need to call our home owners insurance. I just hate that we may have to pay again for a neighbors tree. At least it didn't go through the house. It's a huge tree.
I think if it's on their property, it's their responsibility but definitely contact your insurance company. Depending on your coverage, you can make a claim through them to get it fixed and then they may go after your neighbor's insurance company.
