I know there are a few lawyers on here, so I figured it can't hurt to ask, does anyone know the rules on service dog accessibility?
We moved into a new apartment building last week and on the main floor there is a kids zone for kids 5 and under. It's all padded gym equipment and stuff for the kids to climb around in. I brought DS down this afternoon to play for a little while and a woman was in there with her daughter and her dog. Dog was running all over, climbing on the trampoline and other equipment. After they left there was dog hair everywhere. DH and DS are allergic so it's definitely a concern.
I spoke to the building manager and they said they weren't sure what they could do since that dog is a service dog and the woman is visually impaired. Now I've seen the woman around the building without the dog, so I'm not sure the severity of her disability. I told the manager that I could understand if the dog was sitting by her, but the fact that the dog was running around climbing on the equipment meant for children was an issue. Manager is supposedly looking into and will do his best to address it, whatever that means.
So am I being a jerk or is it reasonable to expect that the dog is leashed and contained in a kid area? Does anyone know if you can ban a service animal from a specific room within a building? DS allergies aren't terrible, but I know for some people just the hair could cause a severe allergic attack so I would think this would be a concern for the building as well.
