Agreed. I know that FMLA does't apply if it's less than 50 employees, but she says that they don't do anything by the book, so I wish I knew more about her short - term disability, because that's all I can think of too.

sstwinklinglites unfortunately FMLA is the only thing that protects the job while out on any kind of leave at this point. If the company has STD and she qualifies, then she should be able to use it. But a lot of policies have a year waiting period. STD policies aren't protected by ACA so the pre existing condition clauses don't apply to them. You're right that 50 and less or less than 1 year of employment, you don't get FMLA.
