Actually, you do not have the "right" to resist what you believe is an illegal arrest. SOTU has upheld that several times precisely to avoid these situations.
As a cop, 98% of the people I arrest think I'm "illegally arresting" them. No one ever wants to believe they're wrong. Guess what? They are. I've been injured far more times from folks resisting arrest than I've ever injured other folks. But I'll do what it takes to carry out my lawful duties. I don't have the luxury of walking away.
Also there's no such thing as an "unarmed" person when you are an armed LEO. As many officers have found out the hard way, your gun can always be taken from you, and a person can kill with their bare hands. I've seen it done, and I've been in those situations. Using any sort of force is never an easy decision, but keeping peace & order can be violent. Hard truth, as unpopular as it may be. If you've been lucky enough to live a life where violence hasn't touched you directly, I envy you. But it's not a universal reality. I still try to make it one though.
I appreciate the practical issues and, frankly, it's great to have the perspective. The "rights" issue depends on the state, the level of force, and the underlying source of the right. (I understand the state common law shifts, but to which SCOTUS cases are you referring?) Of course it's an objective standard, so the belief issue's a nonstarter. Totally agree: if you're wrong, you're wrong.
ETA: For clarity's sake, I'm not saying "you're wrong" - I'm referring to belief re unlawfulness of arrest.
My post got eaten Here it is again: UO: I hate when people compare the animals to human babies. Just no. Not even close. Don't tell me about how you were up all night with your sick puppies when I tell you I was up all night with my sick toddler. It's not even the same.
OMG I love you, go watch this. Seriously the funniest "having a dog totally prepares you for a baby" video I have ever seen.
And just no no no to the people who say it's the same or that it's good practice or whatever. And I am a total dog person.
I will say being up with a sick dog SUCKS because well... if they're sick it's generally so much grosser than a kid. To be fair, I have a 95 pound shepherd and anything that comes out of her is grosser and bigger than anything that comes out of my daughter. So if I'm complaining about a kid who won't sleep (which generally goes on for a long time), and you bring up being up with a sick dog (who is up for maybe 1-2 nights), you'll probably get a super disgusted face from me but less sympathy for the exhaustion and worry.
