Backstory: DH got headhunted by a new company and started his new position on September 1st of 2014. We found out we were pregnant on September 24th of 2014. His company has been very supportive and excited for our pregnancy/new baby the whole time...up until now.
Several months before we gave birth, DH talked with his company about take Paid Family Leave. In our state, new parents can take 6 weeks of paid leave within one year of a new childs birth. His company was 100% fine with my husband taking this leave. The plan they formed was that he would take 1 week off when baby was born, 4 weeks off when she turned 6 weeks, and then have 1 more week to use later in the year. That has been the plan since I was 5 months pregnant. DH has reminded them several times of this. Everything has been ok'd many many times over the course of many many months.
His leave started on Monday. On Monday he received an email from his HR manager saying "Oh, you can't qualify for PFL unless you've been with the company for 1 year. So you won't be getting paid for this leave". Well, if he's not getting paid, we cannot afford for him to take the leave. He called his HR manager and was basically like "Um, what? Why the hell are we finding this out on day 1 of my leave, when this has been the plan for almost 6 months now?". She said she would look into it. She then called back and said "Oh, ok. You qualify for payment once you've reached 1,200 hours, which you have. So you'll qualify."
Then about 2 hours later we got another call from her saying "Oh, so and so has booked a vacation and we're going to be a little short staffed, so would you be willing to put your leave off by a month?"
Well, we had it planned this way so that we would have time together, to bond as a family of 3. If he put his leave off by a month, he would start his leave right when I went back to work. So he told her no. He told her "My wife needs help and I need to be here for my family, so no. I'm going to stick to our plan, that we've had worked out for the past 6 months." She told him ok, no problem.
Then she called back again and told him "Oh, you cannot claim PFL benefits at the same time as your wife. So, you won't be able to get paid if she's getting her benefits. So, I guess you can't take your leave now." He told her we were going to look into it and call her back today.
I called the PFL office today and sat on hold for 30 minutes. When I finally got someone on the phone, they told me "No, you can both absolutely claim benefits at the same time. That's why the program exists."
So now DH is trying to get his HR Manager back on the phone to tell her this info and try and figure out why they are trying to keep him from taking his leave. It seems like his company is trying to pull some shady stuff right now, and I'm not having it! It is a State run program. You cannot keep an employee who qualifies from using it!
