And the number of other similar but less publicized individuals disregarding same sex marriage rulings baffle me. I get it...goes against their personal beliefs. But she was elected to a position that in her oath requires her to issue marriage licenses for lawful marriages. Her job description doesn't say she gets to create law, interpret law, disregard law, only comply with laws in effect when elected, just carry out the current laws. I can almost see judges making a case for this. They do interpret law, but only at their level. If a higher court overrules then, sorry buddy your ruling no longer means ish.
Maybe I'm naive or just a brainwashed minion, but I think one has to take an oath for such an office with the understanding the conditions in which you take that oath might change. If you aren't comfortable with that change, step down and access the appropriate channels to try and seek the change you desire.
Perhaps an extreme example...Just because a soldier is down with the current foreign policy when they enlist or commission doesn't mean they get to say "sorry POTUS, I would have gone to Afghanistan for this reason, but not that one." The oath is taken to do their job. Their job is not to declare war or authorize military operations. You take the oath knowing you may be asked to carry out operations that could go against personal beliefs. If they have a problem with it and are a conscientious objector they no longer do that job.
I get she is elected and they can't remove her, but I feel there should be some mechanism for the county to comply with the ruling so those seeking licenses can do so. If she can't carry out the duty I feel she needs to step down. Her legal situation is still pending so I get it, wait. But shouldn't they be considering an interim clerk that is willing to be in compliance with the current ruling? When she's on vacation does that office not hand out licenses? Who steps in and fills that role? Maybe that person doesn't object to issuing licenses for lawful marriages as that particular office is supposed to do.
